Murphy Desmond Work Cited Extensively by State High Court
Attorneys Bob Pasch and Brian Thill, co-authors of Wisconsin Collection Law, recently had their publication cited on numerous occasions in the Supreme Court of Wisconsin’s decision in Associated Bank v. Collier. The case involved a collection dispute among competing creditors. Interestingly, both the majority and the dissent cited the 2-volume treatise in support of their positions. The majority quoted Wisconsin Collection Law to affirm that a supplemental examination, or post-judgment deposition, is merely a discovery tool. Whereas, the dissent extensively quoted the same work to argue that the majority was contorting and “blithely” overturning 150 years of Wisconsin law by failing to recognize a common law creditor’s lien that arises in connection with the supplemental examination process. The practical effect of Collier is to introduce new uncertainty into collection actions and potentially take away a useful tool from judgment creditors.
Maciolek Wins Concealed Carry Lawsuit
For the first time in Wisconsin, a judge overturned the Department of Justice’s decision to deny a man’s application for a license to carry a concealed weapon. Attorney Mark Maciolek represented the man, appealing the DOJ’s decision on the basis that his conviction for misdemeanor disorderly conduct, dating back to 1995, did not trigger federal law barring him from possessing a firearm. Attorney Maciolek convinced the court that the disorderly conduct conviction was not a misdemeanor crime of domestic violence under federal law. The man has no prior nor subsequent convictions, apart from the 1995 incident. If the case is appealed by the DOJ, it should help to clarify under what circumstances the DOJ can deny an applicant a Wisconsin concealed carry license.
U.S. Supreme Court Rules in Favor of Rameker in Clark v. Rameker
Attorney William Rameker and his team argued in front of the U.S. Supreme Court in the case of Clark v. Rameker, and the Supreme Court ruled in favor of Rameker. The case, which has to do with non-spousal inherited IRAs in bankruptcy proceedings, can be reviewed here. Former WI DNR Secretary Matt Frank Joins Murphy Desmond
Attorney Matt Frank has joined Murphy Desmond and will be practicing in the areas of Environmental Law, Renewable Energy and Sustainabilty, as well as Administrative/Regulatory Law, Municipal Law and Litigation. Matt brings 30 years of experience in government positions as a former Secretary of the Wisconsin DNR, Secretary of the Department of Corrections, and Assistant Attorney General with the Department of Justice.

On October 1, 2013, Murphy Desmond opened a law office in Appleton, Wisconsin, to serve the Fox Cities and surrounding region.
