Attorney Mark Maciolek represents clients in criminal defense and litigation matters in federal and Wisconsin state courts. Mark’s federal experience includes representing clients charged with complex commercial crimes, federal conspiracy crimes, trade secrets crimes, securities fraud crimes, other white collar crimes, federal firearms crimes, drug offenses, and other areas. He also represents individual and corporate clients in federal civil litigation matters, including federal civil lawsuits and bankruptcy adversary proceedings.

Mark handles state criminal matters and related areas, such as juvenile defense. He also handles post-conviction proceedings, appeals, and habeas corpus matters, often in connection with Murphy Desmond’s immigration practice group. Mark’s state court civil litigation practice includes trial and appellate representation for individuals and corporate clients.

A shareholder at Murphy Desmond S.C., Mark has defended Wisconsin public officials in civil lawsuits. In a rare quo warranto action, Mark successfully defended a public official from being removed from office. The case went all the way to the Supreme Court of Wisconsin in just 10 months.

While Mark always endeavors to resolve cases without trial, he is a trial lawyer. He has defeated some of the best trial lawyers in Wisconsin, including a senior federal prosecutor, seasoned state court prosecutors, and an award-winning civil litigator. Mark will try any case, regardless of how difficult, and he has tried cases in federal court, bankruptcy court, state circuit court, municipal court, and in administrative forums.

Mark is bilingual and frequently assists Spanish-speaking clients. Prior to joining Murphy Desmond in 2013, Mark was a solo practitioner in Madison, Wisconsin. He is rated "Superb" on Avvo.com and was named a "Rising Star" in Criminal Defense Law by Wisconsin Super Lawyers. Most recently Mark was recognized by Best Lawyers in America 2024 in Criminal Defense: General Practice; and Criminal Defense: White Collar Practice.
