ILLUSTRATIVE REPRESENTATIONS IN CHAPTER 11 CASES

Ace Baking Company – represented Creditors' Committee.  This was the world's largest ice cream cone manufacturer.  The case resulted in a sale of the company, providing a small dividend to creditors, and provided vendors with an ongoing customer.

Arbor Freight Company – represented Debtor, an interstate freight carrier.  A consensual Plan of Reorganization was confirmed and the company continues in operation.

Brandt, Inc. – represented Creditors’ Committee.  The Plan was confirmed which paid more than $6 million of trade debt, a 100% dividend.

Carley Capital Group - represented the nation-wide Creditors Committee.  A Plan of liquidation was successfully negotiated by Murphy & Desmond, S.C., which provided for the Committee and its agents to oversee and execute the liquidation Plan.  The debtor was a national real estate development firm dealing primarily in government funded projects.  The case involved approximately $100 million in debt and assets of approximately $75 million in value located on both coasts and in the midwest.

DEC International, Inc. – represented the purchaser of Boumatic assets.  This case involved a robotic milking machine and dehumidifier manufacturer.

Freedom Plastics, Inc. – represented Debtor, a PVC pipe manufacturer, and successfully reorganized the company through an equity takeover by outside investors.  Creditors received nearly 50% in dividends from this reorganization and nearly all employees and the company’s market share were maintained.

Lawrence Lappin – represented the Creditors Committee in this case.  The Debtor was a large real estate developer. A Plan was confirmed paying unsecured creditors a 100% dividend, plus interest on their claims.

Milwaukee Cheese Co., Inc. – represented the operating Trustee of the parent and three subsidiaries in Chapter 11. The liquidation of the Milwaukee Cheese conglomerate repaid creditors more than $100 million.

Northern Conveyer, Inc. – represented Debtor in its Chapter 11 reorganization.  This case resulted in a confirmed consensual Plan which has now been completed.

TAK Communications Inc. – represented a bond holders committee owed in excess of $80 million.  In addition, we represented an asset purchaser.  Tak Communications owned and operated nearly two dozen television and radio stations across the country.  A Plan of Reorganization paying secured creditors and bond holders about 75% in debt securities, plus equity of about one-third of the reorganized debtor was negotiated and confirmed.

The Company Store, Inc. – represented Debtor and its three related companies in this Chapter 11 action. Murphy Desmond negotiated the successful sale of the companies and The Company Store continues as an operating entity today.

Wintersilks, Inc. – represented Debtor and a Plan of Reorganization was confirmed by the Court.  The company continues its operations today.
