Attorney Nicole Pellerin Presents at Wisconsin State Bar Bankruptcy Workshops

In May 2023, Murphy Desmond Attorney Nicole Pellerin presented at “The Basics of Filing Chapter 7 & Chapter 13” Part 1 workshop for lawyers and members of the Wisconsin State Bar. Nicole’s topics included: “Means Test” and “Discharge Issues and Fraudulent Transfers”. She discussed the purpose of the means test in chapter 7 and chapter 13 bankruptcy cases, how to prepare it, and some tricks of the trade. She also discussed the types of debts that are excepted from discharge, and reasons why debtors may lose their entire discharge.

In June 2023, Nicole presented again at the “Beyond the Basics of Filing Chapter 7 & Chapter 13” Part 2 workshop for Bar members. In this follow-up seminar, Nicole’s topics included: “Contested Matters, Objections to Proofs of Claim, and Adversary Proceedings, Oh My!”; “Preferential and Fraudulent Transfers”; and “After-Acquired Assets”. She explained the differences between the procedures and processes governing various types of contested matters, avoiding preferential transfers, the trustee’s due diligence requirement, and who or what can be liable when a transfer is avoided. Nicole also discussed the types of assets that can become property of the bankruptcy estate after a bankruptcy petition is filed. 

Both seminars, which are part of the State Bar of Wisconsin PINNACLE series for 2023, can be purchased to view online for Bar members as part of their Continuing Legal Education (CLE) Credits.  

Nicole’s practice at Murphy Desmond includes representing creditors and debtors in all types of bankruptcy and insolvency proceedings. She is also a chapter 7 trustee for the Western District of Wisconsin.
